At Imaginox Academy of Creative Arts Ltd we believe strongly in protecting the privacy of our members' personal information. This Privacy Policy is designed to help you understand how we collect and use the personal data we collect from you or you provide to us, and also to help you make informed decisions when using the Imaginox website and services. Please take a moment to read the Privacy Policy to determine how your personal information will be treated as you make full use of our services.
This Privacy Policy applies to all of the products, services and websites offered by Imaginox Ltd, or its subsidiaries or affiliated companies collectively called the "Imaginox Services".
By using or accessing the Imaginox website, you are accepting the terms of this Privacy Policy which forms part of our Terms and Conditions. If you do not agree to the terms of this Privacy Policy, please do not use the Imaginox website.
Imaginox Services reserves the right to modify this Privacy Policy at any time without giving you prior notice. You should review this Privacy statement regularly and your continued use of the Imaginox website following any such modifications constitutes your agreement to be bound by this Privacy Policy as modified.
For your protection Imaginox is registered in accordance with the Data Protection Act 1998 (“the Act”), and it operates in accordance with the Act (www.dataprotection.gov.uk) and have provided appropriate notifications to the Information Commissioner. What information is collected
We offer a number of services that do not require you to register for an account or provide any personal information to us, such as access to the content on the magazine section or home page of the Imaginox website. However, when you sign up for the Imaginox Services or promotions that require registration, we ask you for personal information, including your name, email address, role in the industry, personal and professional interests, company name and details and an account password and some optional details about yourself. We also collect personal information from you when you submit comments onto the Imaginox website, participate in message boards, blogs and other such user generated content facilities or send emails to us.
For certain services, such as purchasing, we also request credit card or other payment account information, which we maintain in secure form. We may combine the information that you submit under your account with information from other Imaginox Services or third parties, in order to provide you with a better experience and to improve the quality of our services.
In accordance with our Privacy Policy, we would only use or disclose personal information that you have provided to us if:
• You have authorised us to do so or posted publicly on the Imaginox website.
• We have given you notification of intended use or disclosure and you have not objected to that use of disclosure.
• If we are required to do so by law or if disclosure is reasonably necessary to safeguard our rights or property, or to prevent unlawful activity.
Your personal information is available to you, and capable of being corrected or updated, through your Imaginox Profile Page set up by you on the Imaginox website.
You are also required to provide and verify a valid e-mail address before your account creation process can be completed.
Use of your Information
The information we collect may be used:
- To process your payment for membership subscriptions or other goods or services ordered on our site or to fulfill such orders.
- To provide our customer support service and to verify any claims or requests you make if you use our customer support service.
- To enforce our terms and conditions and prevent or detect hacking activities, security breaches or safety risks in connection with our websites.
- To send service announcements and messages. For example, a reminder is sent to members if a subscription payment is due.
- To aggregate information to generate anonymous statistics regarding use of our websites. We may share this anonymous information with our partners and advertisers. This is not linked to any personal information that can identify any individual person.
- To analyse patterns and trends of use and the uptake of educational courses and facilities.
- For our own internal marketing and demographic studies and to help us improve our website.
In the event of an actual or proposed (including as part of negotiations for any) merger, or business combination or sale of substantially all of our assets or a business operation to which such information relates or as provided under bankruptcy or applicable insolvency laws or by the enforcement of equitable rights.
If your personally identifiable information or email address changes, or if you no longer wish to be a member of Imaginox Services, you may correct, update, delete or deactivate your Membership through the Member's account settings menu option found at the top of all pages when logged on to the Imaginox website. We will endeavour to respond to all email enquires within seven working days.
Emails you receive from Imaginox Services
As part of the Imaginox Services, we send members newsletters and mails that you can opt-in and opt-out of on the profiling section of the website. You may also receive email notifications with regard to a particular course or module or item of content that you have purchased on the Imaginox website.
Choice / Opt-Out
We provide you the opportunity to 'opt-out' of having your personally identifiable information used for certain purposes during the registration process.
You may opt-out of any or all of the newsletters and emails we send you by changing your options at any time on the profiling section of the Imaginox website.
You may also opt-out of receiving them by following the instructions included in each newsletter or email we send you or by emailing us at: support@imaginox.co.uk with your request.
Information Sharing
We may share with individuals and third parties certain pieces of aggregated, non-personal information, such as the number of users on the Imaginox website, or how many users have viewed a profile or clicked on a particular piece of artwork. Such information will never identify you individually.
We only share personal information with other companies or individuals outside Imaginox Services when we have your consent or as described under this Privacy Policy. We require opt-in consent for the sharing of any sensitive personal information.
We might also share personal information with third parties outside of Imaginox Services to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of Imaginox, its users or the public, as required or permitted by law.
We use the information you provide about yourself when placing an order only to complete that order. We do not share this information with outside parties except to the extent necessary to complete that order or when we have your specific consent to do so.
We use non-identifying and aggregate information to better design our website. For example, we may tell an advertiser the number of individuals visited a certain area on our website, or the number of men and number of women that filled out our registration form, but we would not disclose anything that could be used to identify those individuals.
Sharing and use of information
Any member or guestto the Imaginox website anywhere in the world can view your profile information, videos and photos that you have uploaded to the Imaginox community. You can control what part of your profile information, photos and videos is visible to members and guests of the Imaginox website.
The over-riding principles we apply are these:
We, and (where relevant) our credit card processing agents, will not supply your personal data to a third party for commercial exploitation except as consented to by you in accordance with prevailing law.
Profile Information. Some or all of the information, such as your username and industry role, are held for members only and will be publicly available to guests and members of Imaginox. If address details are submitted to the Imaginox Services, they are not made publicly available.
Email addresses. We do not directly make your email address available to any other member of the Imaginox Service. Similarly, when you send an email to another member through the Imaginox Service, neither the sender's nor the recipient's email address is disclosed by the Imaginox Service itself. Members can, however, choose to make their email addresses known to other Members; however, Imaginox does not recommend that you do so, and any such disclosure is at the Member's own risk. Members may change the email address we hold them at any time by visiting "Edit Personal Details", which is accessible from the Member's account settings found at the top of all pages when logged on to Imaginox website. If your email system automatically responds to a contact email with a read or delivery receipt, your email address will be revealed. No tracking technologies are used within / in conjunction with emails nor do we share, sell, rent or trade PII with third parties for their promotional purposes.
Un-validated Memberships.If you register for the Imaginox Service, and you receive a validation email, but fail to validate your Membership then we may contact you via email at periods of 24 hours, 7 days, and 30 days at your registered email address to notify you of the invalid status. Should you fail to respond to these notifications then we may send you one final notice before the un-validated Membership is removed.
Advertising.The Imaginox Service may include interactive advertising for other businesses. We use third-party advertising companies to serve ads and collect information when you visit the Imaginox website. These companies may use information (not including your name, address, email address or telephone number) about your visits to this and other websites in order to provide advertisements on the Imaginox website, other websites and other forms of media about goods and services of interest to you.
Telephone numbers.You may enter a contact telephone number in your Personal Details. This number is for internal use only, for future or current services such as SMS. Your number will never be disclosed to any third party without your prior consent. Should we introduce an additional service which utilises telephone numbers, or we wish to provide you with informational content via your mobile phone, you will be given the option to agree to this, as we believe it should be your choice what services you receive.
Credit Card information.There has been a lot of publicity about Credit Card security on the Internet so we work with the leading Merchant Providers in the industry who specialise in Fraud and Data Verification. Members' credit or debit card information is encrypted and stored securely. We share your billing information with such companies insofar as necessary for the processing of your payment or to prevent or detect fraud. These companies have agreed not to retain, share, store or use your personally identifiable information for any secondary purpose.
Imaginox companies and subsidiaries.We may share data supplied by you (or collected about you) with our subsidiaries and other companies owned by us, but only for the purposes described in this policy.
Changes in Imaginox’s business.If all of the assets which Imaginox Services use to operate its business (or substantially all of them) are acquired by a third party, we may transfer personal data we then hold to that party.
Place of processing.Imaginox Services process personal information on our servers across the world. In some cases, we process personal information on a server outside your own country.We will take reasonable steps to protect your personal information collected using the Imaginox website from unauthorised access, modification, loss or misuse. The computers and companies that process data on our behalf are based in the United Kingdom and other countries, some of which may be outside the European Union ("EU"). Thus, your personal data may be transferred to, processed and held both inside and outside the EU. Countries outside the EU may not have as well developed data protection laws in place to protect your information as those inside the EU, but we will ensure your personal data is treated in compliance with those laws and this Privacy Policy.
Sharing Information
When you use the Imaginox Service, you may form relationships, send messages, perform searches and queries, form groups, set up events, and transmit information through various channels. We collect this information so that we can provide you the service and offer personalised features. In most cases, we retain it so that, for instance, you can return to view prior messages you have sent or easily see your friend list. You post a User Submission as defined in the Imaginox Terms and Conditions on the Imaginox website at your own risk. Although we allow you to set privacy options that limit access to your pages, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that User Submissions you post on the Imaginox website will not be viewed by unauthorised persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Imaginox website. You understand and acknowledge that, even after removal, copies of User Submissions may remain viewable in cached and archived pages or if other Users have copied or stored your User Submissions.
We may also collect information about you from other sources, such as newspapers, blogs, instant messaging services, and other users of the Imaginox service through the operation of the service (e.g. photo tags) in order to provide you with more useful information and a more personalised experience.
We may also store information about the films previewed in streaming flash format. The information may be used to determine website usage patterns.
Your name and profile picture thumbnail will be available in all search results across Imaginox Services and may be searchable through third party web-sites with which we partner (such as sites for which we provide a social network service) and third party search engines, and may be automatically notified to third party tracking websites/weblogs; in each case, you can prevent this happening by not including any of these details in the profiling section of the site.
The fact that your Imaginox profile has been added or updated, as well as a short extract from the title page of your Imaginox profile, may be automatically notified to third party tracking websites/weblogs (thus increasing the traffic to the Imaginox website, and potentially to your own Imaginox profile). This can be prevented by unticking or opting out of receiving information from third party partners and sponsors on the personal profiling section of the Imagine website.
Our Commitment To Data Security
To prevent unauthorised access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. However no data transmission over the internet can be 100% secure so we do not guarantee the security of your personal information and/or use of the Imaginox website.
Account information for Imaginox website members are password-protected so that you and only you have access to this personal information. You may edit your Imaginox website account information by logging into your Member account on the website and revising your personal information.
We recommend that you do not divulge your password to anyone. We will never ask you for your password in an unsolicited phone call or in an unsolicited email. Also remember to sign out of your Imaginox website account and close your browser window when you have finished your activities. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library.
Collection of other information - Cookies
What are Cookies and how does Imaginox Services use them?
In addition to personal information, we may collect information about you automatically when you visit the Imaginox website. The collection of information may involve the use of cookies and web beacons. A web beacon is a small graphic image placed on a web page that is designed to allow us to monitor traffic on the website. How You Can Access Or Correct Your Information
You can access all your personally identifiable information that we collect online and maintain by accessing your personal profile using ‘My Account’ or ‘My Profile’ section of the Imaginox website. Here you can change and edit your personal settings, and select which personal information you make available on your public profile. We use this procedure to better safeguard your information. You can also request that your personal information details be updated at any time by emailing us at support@imaginox.co.uk. Please be aware that it may take several hours for the change you make to take effect in the public areas of the website.
Remove details
You may have your registration details removed at any time by emailing us at support@imaginox.co.uk. We will endeavour to remove your details within 48 hours of receipt of the email. Media files uploaded by members to the Imaginox website may not be removed and remain subject to our Terms and Conditions.
Disclosure for legal reasons
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our website.
Links to third party sites
Our website may contain links to other sites operated by unrelated third parties. In addition if you click on an advertisement on our website, you may be directed to a web page within our website or to a third party website. We are not responsible for the privacy practices, or the content, of those websites or services of other companies or organisations to which we link or which link to us or which provide goods or services to our users from their websites (such as co-branded, white label or affiliate sites).This Privacy Policy does not apply to such third party sites. We do not exercise control over other sites linked from our services, either by us or by user-generated content in our services. These other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you. Children’s Use of the Imaginox Website
This website is directed at persons over the age of 13 and we do not knowingly collect personal information from or about children under the age of 13. If at any time we learn that the information we have obtained relates to a child under the age of 13, such information will immediately be purged from our records.
International Users
The Imaginox Services is hosted in the United Kingdom but operates globally. If you are a user accessing the Imaginox website from the European Union, United States, Asia or any other region with laws or regulations governing data collection use and disclosure, that differ from United Kingdom laws, pleased be advised that through your continued use of the Imaginox website, which are governed by English laws, this Privacy Policy and our Terms and Conditions of Use, you are transferring your personal information to the United Kingdom and you consent to the transfer.
